There is a provision added in Criminal procedure Code-1973 section 357-C ,it provides duty of hospitals.
Treatment of victims: All hospitals ( public or private), shall immediately, provide the frist-aid or medical treatment, free of cost, to the victims of Acid attack (punishable under sec 326-A I.P.C.), Rape (376 IPC ), Rape and causing death or resulting in persistent vegetative state of victim (sec 376-A IPC), Sexual intercourse by husband upon his wife during sepration (sec 376-B), Sexual intercourse by a person in authority (376-C), Gang Rape (376-D), repeat offenders of rape (376-E), and shall immediately inform the police of such incedent.
And if such hospital denies or fails to comply its duty, hall be punished with imprisonment for a term which may extend to one year or with fine or with both..
against such hospital you may file Non Cognizable Report (NCR) / complaint before a magistrate.
